These Terms are a legally binding agreement between you and Trailblazers, a fictional entity based in the scenic region of the Pacific Northwest, founded by seasoned outdoors enthusiasts Anya Sharma and Liam O'Connell. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

All content on the Trailblazers Service, including text, graphics, logos, images, and software, is the property of Trailblazers or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, transmit, display, sell, license, or otherwise exploit any content without the prior written consent of Trailblazers.

User-generated content (e.g., reviews, photos) that you submit to Trailblazers is owned by you. However, by submitting content, you grant Trailblazers a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. This license is granted for the purpose of operating, promoting, and improving the Service.

5. Disclaimers of Warranties

The Trailblazers Service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Trailblazers does not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

We strive to provide accurate and up-to-date information, but we make no representations or warranties regarding the accuracy, completeness, reliability, or suitability of any information, content, or recommendations provided through the Service. Trailblazers is not responsible for any decisions made or actions taken based on the information provided on this website. Users assume all risks associated with hiking and outdoor activities.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Trailblazers, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties;
  • Any content obtained from the Service; or
  • Unauthorized access, use, or alteration of your transmissions or content.

Our total liability to you for any claim arising from or relating to the Service will not exceed the greater of: (a) the amount you paid us, if any, for use of the Service in the past twelve months; or (b) $100 USD.

7. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Washington, USA, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Seattle, Washington.

You agree that any cause of action arising out of or related to the Service must commence within one year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

8. Termination

Trailblazers may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service and may request account deletion by contacting us.
